Successful Disability Claim for a Single Father with PTSD

Michele was a single father of two who worked at a record shop downtown. Each morning, he’d drive his kids to school, then head over to the record shop for his day. He was starting to save up to open his own shop, and he was getting close.

Then, one day at work, Michele was assaulted. A customer came into the shop, got verbally aggressive, and then tried to lash out at Michele physically, lunging across the counter at him. He wasn’t severely hurt, though the customer did manage to hit him several times in the head. He needed to take some time off work to recover, as he’d sustained a mild concussion. Thankfully, after decades of working in the community, he had lots of friends and family to support him. After two weeks, he was back in fighting form. Physically, at least.

His first day back at work was difficult. Trying to get back into the swing of things, it took longer than normal to get the kids to school. He found himself driving too cautiously, going much slower than necessary. Once at work, it was difficult to focus with certain loud music on. They had to keep the volume low, which made the atmosphere at work a little less comfortable than it used to be. Michele was jumpy, irritable, and hard to talk to. He refrained from speaking to most customers out of fear, started snapping at others, and started having panic attacks at work. He was short and angry with his kids when they got home at the end of the day he had a hard time keeping up with the menial tasks around the house.

Eventually, his boss and close friend sat him down and told him to go and see his doctor. He told him to take a couple of days off work, and just try to relax. Maybe they’d rushed him back to work too soon after the incident. His family physician ruled out any possible physical issues. “You’re healthy as a horse,” he said. But something still seemed off. His physician wasn’t convinced that just because he was physically healthy that everything was 100% fine. He decided to send Michele to a psychiatrist to rule out any psychiatric trauma after the incident.

Within a couple of sessions, it became clear that Michele was dealing with post-traumatic stress disorder (PTSD). His mind would race about what could have happened if he hadn’t been able to defend himself, or if no one else had been around to help? He was having flashbacks, revisiting exact moments from that day in vivid technicolor, while remembering flashes after the incident on his home. It kept him up at night and prevented him from doing work in the middle of the day. He couldn’t listen to the same music that was playing in the store without having a panic attack. It was eating him up, and making it impossible to function on a daily basis. He knew what he needed to do.

Michele sat down with his boss, and the two of them looked for options to help him apply for long-term disability. Initially, his claim was denied, with the insurance company citing that he’d had assistance immediately following his incident, and should have no problems returning to work with those resources still in place. Michele was devastated. He couldn’t provide for his kids, he couldn’t help his boss at the shop, he couldn’t even help himself.
