How We Win Your Case: Discoveries

I decided that I wanted to write a series of blogs detailing how the team at Share Lawyers help you win your case. We always keep our clients informed about every step of the mediation process as it helps ease what is already a stressful time in their lives. For that reason, I felt it necessary to do the same for anyone who may be reading and going through a similar experience.

Once we have filed your case with the court, you will often be required to attend an Examination for Discovery. Discovery usually takes place in a Court Reporter’s office where you will be questioned about the various aspects of your case including:

– Your job
– Health condition(s)
– Treatments
– Your usual activities of daily living (your daily activities)
– And other relevant matters to your specific case

Discovery is often scheduled to be completed before any settlement discussions take place either at mediation or a settlement meeting. In some cases, discovery doesn’t have to take place before a serious attempt at settling your case occurs, but that will depend on the specific facts of your case and the issues that are in dispute.

In order to try and ensure that Discovery enhances the value of your case, we prepare you for the types of questions that you can expect to hear so that you can be prepared to answer these in the best possible way so that the questions you give will persuade the insurance company to see you more sympathetically than they have up to that point.  

There is no substitute for preparation and if you follow our suggestions and advice, that will give you the best chance of making the discovery process as positive as possible for your case.

Make no mistake – the insurance company wants to use Discovery to obtain admissions that they can use against you or to find inconsistencies in your answers that can assist them in defeating your claim.
